These Terms govern your use of Kixflow (kixflow.com), operated by Foshan Majiada Trading Co., Ltd. (佛山市马佳达贸易有限公司), Foshan, Guangdong, China ("Kixflow", "we"). By creating an account or using the service you agree to these Terms, the Privacy Policy and the Refund & Cancellation Policy.
1. What Kixflow does
Kixflow is a sourcing information service: you send us photos and a description of a product; we identify the product, contact factories and suppliers in China, and send you information and price quotes. Instant factory offers shown in the portal are summaries we prepare from publicly listed offers.
2. Prices are indicative
Prices, minimum order quantities, lead times and other terms come from factories and are indicative only. They are not binding until the factory confirms them in writing (and we do too, where we take part in the order). Prices can change with quantity, materials, exchange rates or the factory's own decision.
3. We are not the seller
Unless we agree in writing to a separate order or service, Kixflow is not the seller, manufacturer, importer or exporter of any goods and is not a party to your contract with a factory. Any purchase is between you and the factory. Extra services (shipping, paying a factory, certificates) are governed by what is agreed for each service.
4. Your responsibilities
You are responsible for the accuracy of the information you give us; for checking that the goods meet the import rules, standards, labelling, certification, customs duties and taxes of your country; and for the decision to buy from any factory. AI-assisted analysis and translations can contain mistakes: check important details before you order.
5. Your account
You must be at least 18 and able to enter into contracts, give accurate details and keep your password secret. You are responsible for activity under your account. The free trial is once per person; we may refuse or withdraw a trial obtained with several accounts.
6. Plans, credits and free trial
Paid plans give a number of requests per monthly period, as shown on the pricing page when you subscribe. Submitting a request uses one request from your balance. Unused requests expire at the end of the period and are not carried over. The free trial gives a limited number of requests once per customer. Prices and plans may change; a change applies from your next period, after we tell you.
7. Fair use
The service is for genuine sourcing of products for your business. You may not flood the service with requests or access it automatically; copy or resell our results or factory data, or build a database from them; use the service to contact factories for anything other than sourcing; or try to access other customers' data. We may limit use far beyond normal business use (for example with daily analysis limits) to keep the service available to everyone.
8. Prohibited products
You may not request weapons, ammunition or their parts; explosives; drugs or controlled substances; counterfeit goods or goods that infringe trademarks, copyright, designs or patents; or anything illegal in the People's Republic of China or in your country (including goods under sanctions or export controls). We may refuse any request and suspend accounts that break this rule.
9. Content and intellectual property
You keep the rights to the photos and texts you upload and give us a licence to use them to provide the service (including sending product details to factories and our service providers). The Kixflow site, software, texts and design belong to us.
10. Suspension and termination
You can stop using the service and delete your account at any time from your account page. We may suspend or close an account that breaks these Terms, misuses the service or does not pay, and we will tell you why unless the law forbids it.
11. Limitation of liability
The service is provided "as is". To the extent the law allows, we are not liable for the quality, safety, delivery or legality of goods supplied by factories; for the acts or omissions of factories, carriers or other third parties; or for indirect or consequential losses, or loss of profit or business. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
12. Changes to these Terms
We may update these Terms. The date at the top shows the current version; if a change is material, we will ask you to accept the new version before you continue using the portal.
13. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China. Any dispute shall be submitted to the competent people's court in Foshan, Guangdong. If you are a consumer, this does not take away rights you have under the mandatory law of your country.
